These Terms & Conditions ("Terms") govern your use of Weather – by Bloomix Labs ("the app"), an Android application developed and published by Bloomix Labs ("we", "us", "our").
By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.
1. The App
The app shows weather forecasts, air quality, UV, pollen and related information for a location you choose or allow it to detect, along with suggested windows of time suited to activities such as drying laundry, running or cycling.
How it handles information is described in our Privacy Policy, which forms part of these Terms.
2. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, in accordance with these Terms and with Google Play's terms of service.
We retain all rights not expressly granted. The app, its name, its artwork, its interface design and its code remain the property of Bloomix Labs.
3. Weather Data and Attribution
Forecast, air quality, pollen and historical data are supplied by Open-Meteo and its underlying sources, including the Copernicus Atmosphere Monitoring Service (CAMS) and ERA5 reanalysis data from ECMWF. That data is licensed under Creative Commons Attribution 4.0 (CC BY 4.0) and is credited in the app.
We do not produce, verify, or control this data. We present it.
4. Forecasts Are Predictions
This is the most important section in this document, so it is written plainly.
A forecast is an estimate of what may happen, not a statement of what will. Weather models are wrong regularly, particularly beyond a day or two, in mountainous or coastal areas, and during unsettled conditions. The app shows a confidence indicator precisely because forecasts differ in reliability, but even a high-confidence forecast can be wrong.
Suggested activity windows are convenience suggestions. When the app indicates a good window for laundry, a run or a ride, it is summarising a forecast, with all the uncertainty that carries. It is not a promise about the weather and not advice about whether an activity is safe for you.
Do not rely on this app where safety depends on it. It is not suitable for, and must not be used for, aviation, marine or maritime navigation, mountaineering, professional agriculture, construction planning, emergency response, or any decision where being wrong about the weather could cause harm or loss. For severe weather, always follow the official meteorological service and civil authorities for your area. Their warnings take precedence over anything shown here.
Air quality, UV and pollen information is not medical advice. These readings are modelled estimates for an area, not measurements of the air where you are standing, and they can differ substantially from local conditions. If you have asthma, allergies, a skin condition, or any other health reason to care about these numbers, follow the advice of a qualified medical professional rather than this app.
5. Your Responsibilities
You are responsible for the decisions you make using the app, and for judging when a forecast is good enough to act on. Where the stakes are high, check a second source.
If you grant the app location access, you are responsible for whether that is appropriate on the device you're using. The app works without it.
6. Things You May Not Do
You agree not to:
- Reverse engineer, decompile, or disassemble the app, except where that restriction is prohibited by law
- Copy, modify, or create derivative works of the app
- Distribute, sell, sublicense, rent, or lease it
- Remove or obscure any copyright, attribution, or ownership notice, including the weather data attribution required by its licence
- Scrape, redistribute, or resell data obtained through the app, or use the app as a route around the data provider's own terms
- Use automated means to make excessive requests through the app
7. Cost
The app is free. There is nothing to buy inside it, there is no subscription, and it shows no advertising. If that changes in a future version, these Terms and the Privacy Policy will be updated before the change is released.
8. Availability, Updates and Changes
We may update, change, suspend, or discontinue the app or any of its features at any time. Updates may be delivered automatically through Google Play depending on your settings.
The app depends on a third-party data service. If that service changes, restricts access, or becomes unavailable, features may stop working with little or no notice, and that is outside our control.
We may stop supporting older Android versions or older releases, and we may stop distributing the app entirely. A copy already installed will keep working for as long as your device and the data service allow.
9. No Warranty
The app is provided "as is" and "as available", without warranties of any kind, express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.
We do not warrant that the app will be uninterrupted or error-free, that forecasts will be accurate, that data will be available, or that a suggested window will turn out as described.
10. Limitation of Liability
To the fullest extent permitted by law, Bloomix Labs will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, business, goodwill, property, or opportunity, arising out of or connected with your use of, or inability to use, the app — including any loss resulting from a forecast that proved inaccurate, a suggested window that did not hold, or data that was unavailable.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the app is limited to INR 1,000.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and your statutory consumer rights are unaffected.
11. Indemnity
You agree to indemnify and hold harmless Bloomix Labs against any claims, damages, losses, liabilities and reasonable legal costs arising from your misuse of the app, your breach of these Terms, or your use of the app for any purpose excluded under Section 4.
12. Termination
These Terms apply for as long as you use the app. You may end them by uninstalling it. We may suspend or terminate your licence if you materially breach these Terms. Sections 4, 5, 6, 9, 10, 11 and 13 survive termination.
13. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. The courts at Nagercoil, Tamil Nadu, India shall have exclusive jurisdiction over any dispute arising from them.
If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-protection provisions where you live, and you may be entitled to bring proceedings there.
14. General
Whole agreement. These Terms and the Privacy Policy are the entire agreement between you and Bloomix Labs regarding the app.
Severability. If a provision is unenforceable, the rest remain in force and that provision is modified to the minimum extent needed.
No waiver. Not enforcing a provision is not a waiver of the right to enforce it later.
Assignment. You may not assign your rights under these Terms. We may assign ours to a successor in a merger, acquisition, or sale of assets.
Third-party terms. Google Play, and the weather data provider, have their own terms, which apply to their own services.
15. Changes to These Terms
We may revise these Terms. When we do, we will change the "Last updated" date and publish the revised version at the same address. Material changes will be signalled in the app or on our website where practical. Continuing to use the app after a revision takes effect means you accept it.
