Terms & Conditions — Needle: True North Compass

These Terms & Conditions ("Terms") govern your use of Needle: True North Compass ("Needle", "the app"), an Android application developed and published by Bloomix Labs ("we", "us", "our").
By buying, downloading, installing or using Needle, you agree to these Terms. If you do not agree, do not use the app.
1. The App
Needle is a compass. It shows your heading relative to magnetic north and, optionally, true north, along with a turnable bearing bezel, a magnetic field strength reading and a bubble level.
How it handles information is described in our Privacy Policy, which forms part of these Terms.
2. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Needle on devices you own or control, in accordance with these Terms and with Google Play's terms of service.
We retain all rights not expressly granted. The app, its name, its artwork, its instrument design and its code remain the property of Bloomix Labs. Buying the app buys a licence to use it, not ownership of it.
3. Eligibility
You must be at least 13 years old, or the minimum age at which you can consent to use online services where you live, whichever is higher. If you are under the age of majority in your jurisdiction, use Needle only with the involvement of a parent or guardian who agrees to these Terms.
4. Buying the App
Needle is a paid app, sold through Google Play.
The sale is between you and Google. Your payment is processed entirely by Google Play under the Google Play Terms of Service. We never see or handle your payment details. The licence is tied to your Google account, and you can reinstall the app on your devices with that account without paying again.
Refunds are handled by Google under Google Play's refund policy, which includes a short window after purchase during which a refund can be requested directly through the Play Store. Any statutory right of withdrawal or consumer guarantee you have under local law is unaffected by these Terms. We cannot process refunds ourselves, but if something is wrong with the app, write to us — we would rather fix it.
Price may change. We may change the price, run sales, or stop selling the app. A change in price does not entitle you to a refund or a payment, and does not affect a copy you have already bought.
No trial. Google Play does not offer trial periods for paid apps. If you want to see the app before buying, the screenshots and this documentation are what we can offer; we have tried to make them accurate rather than flattering.
5. A Compass Has Limits
This is the section that matters most, so it is written plainly.
Needle reports what your phone's sensors say. It does not contain a compass — it reads the magnetometer, accelerometer and rotation sensors built into your device, and draws the result. Accuracy therefore depends on your hardware, which varies enormously between phone models and can degrade with age.
Magnetic fields are everywhere. Car bodies, speakers, laptops, magnetic phone mounts and cases, steel furniture, reinforced concrete, power lines and electrical equipment all deflect a compass needle. The app shows a live field strength reading and warns you when something nearby looks wrong, but it cannot detect every source of interference, and a confident-looking heading can still be wrong.
Calibration drifts. Phone compasses need recalibrating, and the operating system does this in the background without telling you. A reading that was accurate this morning may not be now.
True north depends on a position that may be stale. The declination correction is computed from your device's last known approximate location. If that position is old or you have travelled a long way since, the correction will be off. If you declined the location permission, the app shows magnetic north, which can differ from true north by many degrees depending on where you are.
Levelling matters. A compass held at an angle reads incorrectly. The bubble level is there for this reason, and a reading taken without levelling the device should be treated as approximate.
So: do not rely on Needle where safety depends on it. It must not be used for aviation, marine or maritime navigation, mountaineering, search and rescue, surveying, emergency response, or any situation where an incorrect bearing could cause harm, injury or loss. For those purposes use a certified instrument, and carry a physical compass and a map where getting lost would be dangerous. A phone can also simply run out of battery, which a real compass cannot.
6. Your Responsibilities
You are responsible for the decisions you make using the app, and for judging whether a reading is trustworthy in the conditions you are in. Where it matters, level the device, check the interference warning, move away from metal and vehicles, and verify against a second source.
7. Things You May Not Do
You agree not to:
- Reverse engineer, decompile or disassemble the app, except where that restriction is prohibited by law
- Copy, modify or create derivative works of it
- Distribute, sell, sublicense, rent, lease or share the app, including by redistributing the installation file to people who have not bought it
- Remove or obscure any copyright, trade mark or ownership notice
- Circumvent or interfere with licence verification or any security feature
- Extract or reuse the app's artwork, instrument faces or engravings
8. Availability, Updates and Changes
We may update, change, suspend or discontinue Needle or any of its features at any time. Updates may be delivered automatically through Google Play depending on your settings.
We may stop supporting older Android versions or older releases, and we may stop selling the app. If we do, a copy you have already bought will keep working for as long as your device allows and can be reinstalled from your Play library, but it will no longer receive updates.
9. No Warranty
Needle is provided "as is" and "as available", without warranties of any kind, express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement, to the fullest extent permitted by law.
We do not warrant that the app will run without interruption or error, that it will work on every device, or that any heading, bearing, field reading or true-north correction it displays will be accurate.
10. Limitation of Liability
To the fullest extent permitted by law, Bloomix Labs will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, property, opportunity or goodwill, arising out of or connected with your use of, or inability to use, Needle — including any loss, injury, delay or cost resulting from an inaccurate heading, a failed or absent true-north correction, undetected magnetic interference, or reliance on the app for navigation.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the app is limited to the greater of (a) the amount you paid for the app, or (b) INR 1,000.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and your statutory consumer rights are unaffected.
11. Indemnity
You agree to indemnify and hold harmless Bloomix Labs against any claims, damages, losses, liabilities and reasonable legal costs arising from your misuse of the app, your breach of these Terms, or your use of it for any purpose excluded under Section 5.
12. Termination
These Terms apply for as long as you use Needle. You may end them by uninstalling it; uninstalling does not entitle you to a refund outside Google's refund policy. We may suspend or terminate your licence if you materially breach these Terms, in particular Section 7. Sections 5, 6, 7, 9, 10, 11 and 13 survive termination.
13. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. The courts at Nagercoil, Tamil Nadu, India shall have exclusive jurisdiction over any dispute arising from them.
If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-protection provisions where you live, and you may be entitled to bring proceedings there.
14. General
Whole agreement. These Terms and the Privacy Policy are the entire agreement between you and Bloomix Labs regarding the app.
Severability. If a provision is unenforceable, the rest remain in force and that provision is modified to the minimum extent needed.
No waiver. Not enforcing a provision is not a waiver of the right to enforce it later.
Assignment. You may not assign your rights under these Terms. We may assign ours to a successor in a merger, acquisition or sale of assets.
Third-party terms. Google Play has its own terms, which govern the sale and distribution of the app.
15. Changes to These Terms
We may revise these Terms. When we do, we will change the "Last updated" date and publish the revised version at the same address. Material changes will be signalled in the app or on our website where practical. Continuing to use Needle after a revision takes effect means you accept it.
