These Terms & Conditions ("Terms") govern your use of Pomey: Pomodoro Focus Timer ("Pomey", "the app"), an Android application developed and published by Bloomix Labs ("we", "us", "our").
By downloading, installing or using Pomey, you agree to these Terms. If you do not agree, do not use the app.
Pomey is a Pomodoro-style focus timer. You set a duration by spinning the fruit on screen, start it with a tap, and the app counts down, rings when the session ends, and tracks your position in a cycle of focus blocks and breaks.
How it handles information is described in our Privacy Policy, which forms part of these Terms.
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Pomey on devices you own or control, in accordance with these Terms and with Google Play's terms of service.
We retain all rights not expressly granted. The app, its name, its artwork, its themes, its sounds and its code remain the property of Bloomix Labs.
Pomey is suitable for all ages and participates in Google Play's Families programme.
If you are under the age of majority in your jurisdiction, use Pomey with the involvement of a parent or guardian, who must agree to these Terms on your behalf. A parent or guardian who allows a child to use the app is responsible for that use, including any purchase made from their device or Google account.
Pomey is free to download and use. An optional one-time purchase, Pomey Pro, unlocks the full set of themes, including themes added in later releases. There is no subscription and no recurring charge.
Purchases go through Google Play. The transaction is between you and Google, governed by the Google Play Terms of Service. We never see or handle your payment details. The entitlement is tied to your Google account and can be restored on your devices by signing in with the same account.
Refunds are handled by Google under Google Play's refund policy, and any statutory right of withdrawal or consumer guarantee you have under local law is unaffected by these Terms. We cannot issue refunds directly, but if something has gone wrong, write to us and we will help where we can.
Preventing accidental purchases. If children use your device, you can require authentication for every Google Play purchase in the Play Store's settings. We recommend it.
Future themes. Pomey Pro includes themes we add later, and we intend to keep adding them, but we do not commit to any particular number or schedule. We will not remove a theme you have already unlocked, and we will not move an existing free theme behind the purchase.
Pomey asks Android to count down and to ring at a set moment. How reliably that happens is partly outside our control.
Background limits. Battery optimisation, doze mode, memory pressure and manufacturer-specific power management can delay or stop a background timer. Several phone makers are notably aggressive about this, and behaviour varies by model and firmware. Force-stopping the app, clearing it from recents, or restarting your device can also interrupt a running session.
The ring depends on your settings. Do Not Disturb, silent mode, a muted alarm channel, Bluetooth audio or a revoked notification permission can all mean you do not hear a session end. Pomey follows your media volume for its sounds and your alarm volume for the ring, by design — it will not override the volumes you have set.
So do not rely on Pomey where something important depends on an alarm. It is a focus timer. It is not an alarm clock for waking up, a medication or medical reminder, a cooking timer for anything that can burn, a timekeeper for exams or interviews, or any other use where a missed or late ring could cause harm, loss or embarrassment. Use a purpose-built, reliable alarm for those.
Pomey is not health or productivity advice. The Pomodoro technique is a widely used working method, not a clinical intervention. The app makes no claim about concentration, productivity, academic performance or wellbeing, and nothing in it is advice from a qualified professional.
You are responsible for configuring the app sensibly, for granting the permissions it needs if you want timers to be reliable, and for checking that it behaves as you expect on your device before depending on it.

We may update, change, suspend or discontinue Pomey or any of its features at any time. Updates may be delivered automatically through Google Play depending on your settings.
We may stop supporting older Android versions or older releases, and we may stop distributing the app. A copy already installed will keep working for as long as your device allows, but will no longer receive updates.
Pomey is provided "as is" and "as available", without warranties of any kind, express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement, to the fullest extent permitted by law.
We do not warrant that the app will run without interruption or error, that a timer will complete, or that a ring will sound at the moment it should.
To the fullest extent permitted by law, Bloomix Labs will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, time, opportunity or goodwill, arising out of or connected with your use of, or inability to use, Pomey — including any session that was interrupted and any ring that was late, silent or never arrived.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the app is limited to the greater of (a) the amount you paid us for the app in the twelve months before the claim arose, or (b) INR 1,000.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and your statutory consumer rights are unaffected.
You agree to indemnify and hold harmless Bloomix Labs against any claims, damages, losses, liabilities and reasonable legal costs arising from your misuse of the app, your breach of these Terms, or your use of it for any purpose excluded under Section 5.
These Terms apply for as long as you use Pomey. You may end them by uninstalling it. We may suspend or terminate your licence if you materially breach these Terms, in particular Section 7. Sections 5, 6, 7, 9, 10, 11 and 13 survive termination.
These Terms are governed by the laws of India, without regard to conflict-of-law principles. The courts at Nagercoil, Tamil Nadu, India shall have exclusive jurisdiction over any dispute arising from them.
If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-protection provisions where you live, and you may be entitled to bring proceedings there.
Whole agreement. These Terms and the Privacy Policy are the entire agreement between you and Bloomix Labs regarding the app.
Severability. If a provision is unenforceable, the rest remain in force and that provision is modified to the minimum extent needed.
No waiver. Not enforcing a provision is not a waiver of the right to enforce it later.
Assignment. You may not assign your rights under these Terms. We may assign ours to a successor in a merger, acquisition or sale of assets.
Third-party terms. Google Play has its own terms, which apply to its own services.
We may revise these Terms. When we do, we will change the "Last updated" date and publish the revised version at the same address. Material changes will be signalled in the app or on our website where practical. Continuing to use Pomey after a revision takes effect means you accept it.
